Dear Sir or Madam,
I write as the leaseholder of the above property to formally request a written summary of costs and access to the supporting documents pursuant to section 21 of the Landlord and Tenant Act 1985 (as amended).
I have received a service charge demand for £4,847.50 for the year ending 31 December 2025. I am exercising my statutory right to request the following information and documents in respect of each item of expenditure included in that demand:
- A written summary of the costs incurred or to be incurred in connection with the relevant period, showing how those costs are reflected in the demand.
- Copies of all invoices, receipts, and accounts evidencing the following expenditure items identified in the demand:
- External fabric redecoration — £1,820.00 (Westgate Contractors Ltd)
- Roof repairs — major works — £1,350.00 (various contractors)
- Buildings insurance premium — £680.00
- Management fee — £997.50 (Westgate Property Management Ltd)
- Copies of any tender documents, three competitive quotes, or other evidence of the procurement process for works exceeding £250 per leaseholder (or £1,000 per block, whichever is lower) under section 20 of the Landlord and Tenant Act 1985.
- A copy of the relevant insurance policy and the schedule of the buildings insurance premium for the current year.
- Evidence of the managing agent's appointment and the fee structure agreed with the landlord, including any referral arrangements with contractors.
Please note that under section 21(3) of the 1985 Act, you are required to provide this summary within one month of receiving this request (or within six months of the end of the relevant accounting period if that is later). Failure to comply is a criminal offence under section 21(5) of the Act.
If you intend to charge for the provision of any documents or copies, please notify me in advance of the amount, as I am entitled to inspect them free of charge at the premises in accordance with section 22 of the 1985 Act.
I should be grateful for your acknowledgement of this request within 14 days and your response by no later than 15 July 2026.
Should you fail to comply, I reserve the right to apply to the First-tier Tribunal (Property Chamber) under section 27A of the Landlord and Tenant Act 1985 to determine the reasonableness of the service charges demanded, and to seek a costs order where appropriate.
